This Acceptable Use Policy (“Policy”) governs your use of the Dealer1 Solutions platform operated by Shitenko Holdings Inc. By using the Service, you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your account.

1. Overview

This Policy governs the acceptable use of the Dealer1 Solutions platform operated by Shitenko Holdings Inc. It is designed to protect all users, ensure compliance with applicable laws, and maintain the integrity of the Service. This Policy supplements our Terms of Service and should be read in conjunction with them.

2. Prohibited Activities

You may not use the Service to:

  • Send unsolicited SMS messages or spam of any kind
  • Harass, threaten, or abuse any person, including customers, employees, or other users
  • Attempt to gain unauthorized access to other accounts or dealerships
  • Circumvent rate limits, security measures, or access controls
  • Use the platform for any illegal purpose or in violation of any applicable laws
  • Upload malicious content, viruses, or harmful code
  • Scrape, crawl, or engage in automated data collection from the platform
  • Resell, sublicense, or redistribute access to the platform without written consent

3. SMS/Messaging Rules

The following rules apply specifically to the SMS and messaging features of the Service:

  • CASL Consent Required: You must have valid consent under Canada's Anti-Spam Legislation (CASL) before sending any SMS or electronic message to a recipient
  • Honor Unsubscribe Requests: You must honor all STOP, unsubscribe, and opt-out requests immediately upon receipt
  • Business Hours: You must not send messages outside of business hours without prior customer consent
  • No Mass Marketing: You must not use the platform for mass marketing campaigns or bulk unsolicited messaging
  • Rate Limits: Rate limits apply to all accounts. Trial accounts are limited to 100 messages per day. Paid accounts are limited to 1,000 messages per day.

4. Account Responsibilities

As a user of the Service, you are responsible for:

  • Maintaining the security of your account credentials and not sharing them with unauthorized persons
  • All activity that occurs under your account, whether or not authorized by you
  • Ensuring that all team members and users within your dealership comply with this Policy
  • Keeping your account information accurate and up to date

5. Enforcement

Violations of this Policy may result in the following actions, at our sole discretion:

  • First Minor Violation: A written warning will be issued and you will be asked to correct the behavior
  • Repeated or Serious Violations: Temporary or indefinite suspension of your account
  • Severe Violations: Immediate termination of your account for severe violations including spam, illegal activity, or actions that threaten the security of the platform
  • No Refunds: No refund will be provided for accounts terminated due to a violation of this Policy

6. Reporting Violations

If you become aware of any violation of this Policy, please report it to us immediately at info@dealer1solutions.com. We take all reports seriously and will investigate promptly. You may report violations anonymously.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time. When we make changes, we will update the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Policy.
